General Terms and Conditions
General Terms and Conditions of the online shop kelme.si are composed according to the Slovenian Consumer Protection Act (ZVPot) and following the recommendations by the Chamber of Commerce and Industry Slovenia and international codes for e-business. The online shop kelme.si is an information system, intended for the presentation and sale of products to users. It is managed by Patrick Sport d.o.o. (hereinafter: provider). Patrick Sport d.o.o. reserves the right to change the Terms and Conditions of the website kelme.si at any time without prior notice.
A user is a person using our system, thus a buyer at our online shop. Upon registration into the online shop the visitor receives a username, identical to their e-mail address, which they set themselves on their profile, and a password. The username and password unequivocally specify and connect with the filled-in data. Upon registration the visitor becomes a user and attains the right to make a purchase. The General Terms and Conditions cover the operation of the online shop kelme.si, the rights of users and the business relationship between provider and buyer.
Right to privacy
The buyer allows the collection and use of the received personal data for the needs of the online shop kelme.si The provider undertakes to permanently protect all personal data in accordance with the Consumer Protection Act (Official Gazette of the Republic of Slovenia Nr. 86/2004) and the Insurance Act. All data, collected on the website kelme.si will be used exclusively for the purposes of sending of orders, informational materials, offers, invoices and other necessary communication. The data in its anonymised summarised form may be used for statistical analyses. The provider will not forward personal data to third parties with the exception of forwarding the data necessary for delivery of products.
The provider undertakes to always make the following information available to the buyer: identity of the company, contact addresses, essential characteristics of goods, availability of products, conditions of delivery of products, clearly and unambiguously specified prices, manner of payment and delivery, temporal validity of offers, deadline, withdrawal conditions and procedure, explanation of the complaints procedure, including all data about a contact person or customer service.
The provider offers the following payment methods in the online shop Patrick Sport d.o.o.:
- payment per pro forma invoice
If you wish to pay your chosen order through your online bank or per a pro forma invoice, transfer the amount to our bank transaction account IBAN SI56 0208 5002 0213 710 at Nova Ljubljanska banka d.d. - BIC code: LJBASI2XXXX).
- payment upon delivery
Pay for your order upon delivery. A provision according to the price list of the Slovenian Post may apply.
- payment by credit card
In the purchase process you will have to choose the provider of the credit card and give in the card number, name of owner, date of validity and CVC code of the credit card.
The provider issues an invoice on a durable medium, with itemised costs and guidance on how to withdraw from the purchase and return the items if necessary and possible.
The sales contract (order) is saved in electronic form on the provider’s network server and is accessible to the buyer at all times in their user profile (My profile).
Validity of offer
All prices are in EUR and are valid on the day of purchase, respectively completion of the order. All prices include VAT, unless expressly stated otherwise. Prices are valid in case of payment according to the above-stated methods of payment, under the above-stated conditions. The prices stated in the online shop are irrevocable and valid only for online orders, thus for some products a difference in price at the online shop compared to other shops in Slovenia can occur. Despite trying to ensure up to date and correct data, it may occur that the data on price is wrong. In this case, or in case the price of the item changes during the processing of the order, the provider will enable the buyer to withdraw from the contract or will offer another suitable solution to the buyer. If an item is not in stock, a change in price can occur, whereof the provider notifies the buyer.
Validity of special offer
The deadline of the special offer is specified alongside the special offer itself. The deadlines for special offers may vary.
1. Order received: After sending the order the buyer receives notification per e-mail that the order has been received. The buyer can access at all times the full information about the status and content of the order on the provider’s website.
2. Order confirmed: When the provider examines the order and checks the availability of the ordered items, they either confirm the order or deny it with justification. The provider can call the buyer at their contact number to verify data or to ensure a correct delivery. Regarding the delivery of goods which the provider does not have stocked, the provider is tied exclusively to the supply by the supplier and the time frame in which the provider's supplier can deliver the goods to the provider. The provider provides updated information to the buyer about the supply of goods. If the supplier does not confirm the supply of the ordered items by the end of the same workday, the provider can cancel the buyer’s order on the grounds of unavailability of goods. The buyer’s order ceases to be valid on the day of cancellation. The provider does not assume responsibility for any potential damages, ensuing from longer supply deadlines or for not supplying goods which are not on stock in the provider's own warehouse.
3. Goods dispatched: The provider prepares and dispatches the goods and notifies the buyer thereof per e-mail. In the abovementioned e-mail the provider provides the buyer with instructions on the return policy, who to contact in case of a delayed delivery and where to turn in case of lawsuit.
The right to withdraw from the purchase, return of goods
The consumer has the right to withdraw from this contract within 14 days after receiving the goods without giving any reason. To enforce the right to withdraw the consumer must notify Patrick sport d.o.o., Celovška 34 1000 Ljubljana, about their withdrawal from this contract with an unambiguous statement (e.g. per post, telefax or e-mail). To this end the consumer may use this optional withdrawal form. If the consumer withdraws form this contract, the undertaking will return all received funds without unnecessary delay and at the latest in 14 days of receiving the notification of withdrawal from this contract. Such a return will be carried out via the same method that was used for the original transaction, unless expressly otherwise arranged; in no case will the consumer carry any costs due to the return of funds. In case of payment upon delivery the payment is returned to the transaction account. The consumer must return the goods within 14 days after the written withdrawal from the purchase. The products must be unused and undamaged. A copy of the order must be enclosed. The direct costs of returning the goods are covered by the buyer. Returning the goods to the undertaking counts as withdrawal from the contract.
Responsibility for material defects
The provisions about responsibility for material defects according to the Slovenian legislature apply for the products in the online shop.
Delivery dates are expressed in the number of workdays, 2-10 days for orders of items in stock an 21 days for orders out of stock. All orders sent on the weekend will be dispatched the next workday.
The provider must deliver the goods in the promised time. The costs of postage are carried by the buyer. Delivery for the kelme.si online shop is carried out by Pošta Slovenije d.o.o. and GLS General Logistics Systems Slovenia, logistične storitve d.o.o. Patrick Sport d.o.o. reserves the right to choose another postal service provider if that would mean a more efficiently carried out delivery.
The provider uses the appropriate technological and organisational means to protect and keep personal data, orders and payments.
Advertising emails must be clearly and unambiguously marked as advertisements. The sender must be clearly marked. The wish to stop receiving advertisements will be unconditionally respected by the provider.
Limitation of liability
The provider makes every effort to ensure that the data published on their website are up to date and correct. There is a possibility of error in the input of data, characteristics of goods, price and delivery date. In the event thereof the provider will notify the buyer about the changes and make possible a withdrawal from the contract or a substitution. All images of products are symbolic and do not guarantee the characteristics of a product. We are not liable for typographical errors.

The process of processing the complaint is confidential. The provider keeps the user informed about the complaint process. The provider makes every effort to settle potential disputes amicably. Should that be impossible, jurisdiction to hear disputes arising from this contract lies with the competent court in Ljubljana.
